XLOGIQX Pty Ltd (“us”, “we”, or “our”) operates the //www.cabidz.com website and the CABIDZ mobile application (the “Service”).

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Information Collection And Use

We collect several different types of information for various purposes to provide and improve our Service to you.

Types of Data Collected

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

  • First name and last name
  • Phone number
  • Drivers licence for driver
  • Taxi Authority Card for driver
  • Photo
  • Driver Information about vehicles (including registration number).
  • Driver Date of Birth
  • Address, State, Province, ZIP/Postal code, City
  • Cookies and Usage Data
  • Geolocation of drivers and driving routes.
  • Driver’s efficiency and ratings
  • Automatically collect information from your devices in connection with your online activity (including, in some cases, specific location information).

 

Facebook Connect:

You can log in to our site using sign-in services such as Facebook Connect. These services will authenticate your identity and provide you the option to share certain basic personal information with us such as your name, email address, Phone, Date of Birth, profile picture to pre-populate our sign up form if permission granted. We do not fetch any friends, contact, likes or any other behavioral analytical data.

 

 

Usage Data

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device (“Usage Data”).

This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the Service by or through a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, Location data (when in use),  unique device identifiers and other diagnostic data.

Tracking & Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and hold certain information.

Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

Transfer Of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside Australia and choose to provide information to us, please note that we transfer the data, including Personal Data, to Australia and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

XLOGIQX Pty Ltd will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure Of Data

Legal Requirements

XLOGIQX Pty Ltd may disclose your Personal Data in the good faith belief that such action is necessary to:

  • To comply with a legal obligation
  • To protect and defend the rights or property of XLOGIQX Pty Ltd
  • To prevent or investigate possible wrongdoing in connection with the Service
  • To protect the personal safety of users of the Service or the public
  • To protect against legal liability

Security Of Data

The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Service Providers

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
Payments
We provide paid services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card/bank account details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Using the CABIDZ app

  • 1.1 You acknowledge that XLOGIQX Pty Ltd does not provide transportation services or function as a transportation carrier, and that all such transportation services are provided by independent third party contractors who are not employed by XLOGIQX Pty Ltd or any of its affiliates.
  • 1.2 The use of the CABIDZ app requires installation of the software and registration of a user account. During the installation of the CABIDZ app, the mobile number of the CABIDZ service user is linked to the respective user account and added to the database.
  • 1.3 Users are responsible for the security of their user name and password for the CABIDZ app. XLOGIQX Pty Ltd may assume that anyone using a user’s user name and password is authorised by the user to do so. Users must notify XLOGIQX Pty Ltd immediately on becoming aware of any unauthorised use of their user name or password or of any other security breach in connection with the CABIDZ app.
  • 1.4 When using the CABIDZ app, the user can choose whether he/she wishes to pay for the transportation service using a credit or debit card.

CABIDZ credit card and mobile payment conditions

  • 2.1 The user of the CABIDZ app can pay for the transportation service (and any tolls, fees or levies payable in respect of the transportation service or this app) with a debit card or credit card payment, which requires the prior activation of the debit card or credit card data within the CABIDZ app. The use of credit and debit card payments are subject to these terms and conditions.
  • 2.2 XLOGIQX Pty Ltd gives estimates of the metered fare as a guide before initiating bidding for the transportation service. The metered fare excludes all taxes, levy, CTP Taxes, Booking Fee, Airport Fee, tolls etc.
  • 2.3 By initiating bidding with drivers booking or hailing and accepting the drivers bid fare you agree to pay the bid amount you accepted earlier.
  • 2.4 You acknowledge to pay the agreed bid fare in full if you cut short the trip where requested trip was less then 15km.
  • 2.5 You acknowledge to pay the system recalculated fare in case of shorter deviated trip where requested trip was more then 15km’s and actual trip was less then the half of requested trip.
  • 2.6 The actual fare may be different to the agreed bid fare as actual will include all taxes i.e. Levy, booking fee, CTP Taxes etc.
  • 2.3 When making credit or debit card payments, the receiver of the payment is XLOGIQX Pty Ltd, who pays the transportation service provider. You agree that payments to XLOGIQX Pty Ltd, are facilitated by CABIDZ. XLOGIQX Pty Ltd appoints CABIDZ Australia Pty Ltd to respond to any complaints and settle any disputes in relation to payments made to XLOGIQX Pty Ltd. You agree to discuss any complaints with CABIDZ Australia Pty Ltd using the contact details in clause 1.5.
  • 2.4 For debit card and credit card payments, XLOGIQX Pty Ltd may charge a service fee for each payment that is added to each order of transportation service. The service fee is for Visa / MasterCard service fees. The amount of the service fee is displayed in the mobile app. Your bank may make additional charges for use of your credit or debit card (which are not shown in the mobile app).
  • 2.65 When creating a trip and accepting the agreed bid fare amount , CABIDZ pre authorise the amount to pre capture the payment to make sure the driver is paid at the end of trip. If trip is cancelled then the captured amount is released.

Ordering or cancelling a trip

  • 3.1 If the CABIDZ app user cancels the ride on/after driver is en-route the cancellation fee is applied.
  • 3.6 The transport service provider may ask you to pay a fee for cleaning a vehicle if you or your co-passengers negligently damage the vehicle or its furnishing (including by blemishing or staining the vehicle or causing the vehicle to smell). The transport service provider may ask you to pay an amount in excess of A$90 for damage to the vehicle. If you do not pay the $90 charge, we may deduct it from your debit card or credit card.

By registering an account with CABIDZ, you accept the following conditions

  • 4.1 Your privacy is important to us. You should read our Privacy Policy at //www.CABIDZ.com/privacy to understand how we collect, use and share information about you.
  • 4.2 CABIDZ shall have a right to make unilateral amendments to the Terms and Conditions and Privacy Policy and to relinquish the database to third parties. We shall notify the users of changes to Terms and Conditions and Privacy Policy.
  • 4.3 CABIDZ has the right to send authentication codes through SMS messages. If you agree through our opt in feature in the CABIDZ app, we may also send you marketing messages.

Apple App Store Provisions

  • 5.1 This clause applies where the CABIDZ app has been acquired from the Apple App Store. You acknowledge and agree that the agreement for use of the CABIDZ app is solely between you and CABIDZ, not Apple, Inc. ( Apple ) and that Apple has no responsibility for the App or content thereof. Your use of the App must comply with the App Store Terms of Service.
  • 5.2 You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the CABIDZ app to conform to any applicable warranty, you may notify Apple, and (where applicable) Apple will refund the purchase price for the CABIDZ app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the CABIDZ app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by the Terms of Service and any law applicable to CABIDZ as provider of the CABIDZ app.
  • 5.3 You acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the CABIDZ app or your possession and/or use of the CABIDZ app, including, but not limited to: (i) product liability claims; (ii) any claim that the CABIDZ app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation; and all such claims are governed solely by the Terms of Service and any law applicable to CABIDZ as provider of the software.
  • 5.4 You acknowledge that, in the event of any third-party claim that the CABIDZ app or your possession and use of that CABIDZ app infringes that third party’s intellectual property rights, CABIDZ, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim to the extent required by the Terms of Service.
  • 5.5 You represent and warrant that (i) You are not located in a country that is subject to U.S. Government embargo, or that has been designated by the U.S. Government as a ‘terrorist supporting’ country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • 5.6 You and CABIDZ acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of the Terms of Service as relates to your license of the CABIDZ app, and that, upon your acceptance of the Terms and Conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms and Conditions as relates to your license of the CABIDZ app against you as a third-party beneficiary thereof.

Google Play Store Provisions

  • 6.1 This clause 9 applies where the CABIDZ app has been acquired from the Google Play Store.
    • 6.1.1 You acknowledge that the Terms of Service is between you and CABIDZ, and not with Google, Inc. ( Google );
    • 6.1.2 Your use of the CABIDZ app must comply with Google’s then-current Google Play Store Terms of Service;
    • 6.1.3 Google is only a provider of the Google Play Store where you obtained the CABIDZ app;
    • 6.1.4 CABIDZ, and not Google, is solely responsible for its CABIDZ app;
    • 6.1.5 Google has no obligation or liability to you with respect to the CABIDZ app or the Terms of Service; and
    • 6.1.6 You acknowledge and agree that Google is a third-party beneficiary to the Terms of Service as it relates to the CABIDZ app.

Your content

  • 7.1 You confirm that any text, images or any other information that you provide to us whilst using the Service ( User Content ) will meet the Rules of Acceptable Use.
  • 7.2 We do not claim ownership in your User Content and ownership will remain with you and any third party whose content you include in your User Content. You grant us a worldwide, non-exclusive, royalty-free and perpetual licence to use, copy, reproduce, distribute, adapt, re-format, modify, publish, translate, licence, sub-licence, and exploit the User Content anywhere and in any form for the purposes of providing our Service (including, where applicable, allowing other users to view your User Content).
  • 7.3 You must ensure that you are able to grant us the above licence for any content owned by a third party that you include in your User Content.
  • 7.4 Our right to use your User Content does not in any way affect your privacy rights.
  • 7.5 We have the right to monitor any User Content and to reject, refuse or delete any User Content where we think that it breaks any of the Rules of Acceptable Use.

Rules of Acceptable Use

  • 8.1 In addition to the other requirements within these Terms and Conditions, this section describes specific rules that apply to your use of the CABIDZ app ( Rules of Acceptable Use ).
  • 8.2 When using the CABIDZ app you must not:
    • 8.2.1 Circumvent, disable or otherwise interfere with any security related features of the CABIDZ app;
    • 8.2.2 Permit another person to use the CABIDZ app on your behalf unless such person is authorised by you;
    • 8.2.3 Use the CABIDZ app if we have suspended or banned you from using it;
    • 8.2.4 Advocate, promote or engage in any illegal or unlawful conduct or conduct that causes damage or injury to any person or property;
    • 8.2.5 Modify, interfere, intercept, disrupt or hack the CABIDZ app;
    • 8.2.6 Misuse the CABIDZ app by knowingly introducing viruses, Trojans, worms, logic bombs or other material which would harm the CABIDZ app or any user of the CABIDZ app;
    • 8.2.7 Collect any data from the CABIDZ app other than in accordance with these Terms and Conditions;
    • 8.2.8 Submit or contribute any User Content that contains nudity or violence or is abusive, threatening, obscene, misleading, untrue or offensive;
    • 8.2.9 Submit or contribute any User Content that you do not own or have the right to use or otherwise infringe the copyright, trademark or other rights of third parties;
    • 8.2.10 Use any User Content in violation of any licensing terms specified by the owner;
    • 8.2.11 Submit or contribute any information or commentary about another person without that person’s permission;
    • 8.2.12 Threaten, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety or be likely to harass, upset, embarrass, alarm or annoy any other person; or
    • 8.2.13 Use any automated system, including without limitation ‘robots’, ‘spiders’ or ‘offline readers’ to access the CABIDZ app in a manner that send more request messages to the CABIDZ app than a human can reasonably produce in the same period of time.
  • 8.3 Failure to comply with Rules of Acceptable Use constitutes a serious breach of these Terms and Conditions, and may result in our taking all or any of the following actions (with or without notice):
    • 8.3.1 Immediate, temporary or permanent withdrawal of your right to use our CABIDZ app;
    • 8.3.2 Immediate, temporary or permanent removal of any User Content;
    • 8.3.3 Issuing of a warning to you;
    • 8.3.4 Legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
    • 8.3.5 Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
  • 8.4 The responses described in clause 8.3 are not limited, and we may take any other action we reasonably deem appropriate.

LIABILITY

  • 9.1 The CABIDZ App, its content and functionality is provided on an ‘as is’ and ‘as available’ basis. To the fullest extent permitted by law, CABIDZ and its Affiliates exclude and disclaim to the maximum extent permitted by law all guarantees, conditions, warranties or terms of any kind, whether express or implied or imposed by any applicable law. CABIDZ and its Affiliates do not represent, warrant or guarantee that access to the Website or CABIDZ App will be uninterrupted or error free.
  • 9.2 Nothing in the Agreement excludes, restricts or modifies any guarantee, warranty, term or condition, right or remedy implied or imposed by any applicable law which cannot lawfully be excluded, restricted or modified.
  • 9.3 If any guarantee, condition, warranty or term is implied or imposed by any applicable law and cannot be excluded ( Non-Excludable Provision ), and CABIDZ is able to limit your remedy for a breach of the Non-Excludable Provision, then CABIDZ’s liability for breach of the Non-Excludable Provision is limited exclusively (so far as applicable laws do not prohibit) to one or more of the following at CABIDZ’s option:
    • 9.3.1 in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or
    • 9.3.2 in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.
    • 9.4 As the usage of CABIDZ App for requesting passenger transportation services depends on the behaviour of Customers, CABIDZ and its Affiliate do not guarantee that your usage of the CABIDZ App will result in any requests for transportation services.
  • 9.5 To the maximum extent permitted under the applicable law, CABIDZ and/or any of its Affiliates, representatives, directors and employees are not liable for any loss or damage that you may incur under or in connection with the Agreement or as a result of using the CABIDZ App, including but not limited to:
    • 9.5.1 any direct or indirect property damage or monetary loss;
    • 9.5.2 loss of profit or anticipated savings;
    • 9.5.3 loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from interruption of the business;
    • 9.5.4 loss or inaccuracy of data; and
    • 9.5.5 any other type of loss or damage.

Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Children’s Privacy

Our Service does not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Changes To This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy.
